Tractor offers a digital service that allows you to display your advertisements on our digital out-of-home displays ("the SME Launchpad").

These Terms govern your use of the SME Launchpad; please read them carefully. The mission of the SME Launchpad is to make digital advertising available to Small businesses and for Small businesses to experience the process and potential of digital out-of-home advertising. We hope that as your business grows, you will choose to use our services in the future.

We currently don't charge you to use the SME Launchpad, but this may change in the future. We will notify you at least 30 days in advance when our pricing policy changes. How it works:

1. You need to register an account for your business with us, and we will allocate you your login credentials.
2. You must maintain the confidentiality of your login credentials and are responsible for all activities under your credentials.
3. You can then use your login credentials to access our SME Launchpad.
4. The SME Launchpad allows you to upload the advertising content you wish to display to your potential customers on the digital out-of-home displays that may be available to you.
5. We check all content uploaded on our SME Launchpad, and we strictly reserve the right to reject or cancel any content that we, in our sole and exclusive opinion, do not want to be displayed on our SME Launchpad.
6. We display your advertisement, subject to the availability of slots on our digital out-of-home displays. Please note that paid slots will always get priority over SME Launchpad's displays. You agree not to hold us liable should we fail to display your advertisements for any reason on any of our displays at any time.
7. We provide you with feedback on your campaign.

The SME Launchpad is only available to Small businesses and registered non-profit companies.

We don't want the mission of our SME Launchpad abused by non-qualifying businesses, or businesses that have not successfully registered with the SME Launchpad, displaying advertisements via businesses registered with our SME Launchpad. We strictly reserve the right to reject or cancel any content that we, in our sole and exclusive opinion believe:

1. Is not your "first party advertising"¹ and strictly reserve the right to cancel your registration with the SME Launchpad if we believe this happened under your login credentials; or,
2. You don't have the right to display the content.

You agree to indemnify us in full for any damages, or losses that we may suffer, including all our legal costs to deal with the claim if we are held liable for any reason, for any content displayed on our out-of-home displays, irrespective of how or why such content managed to pass our scrutiny.

We reserve the right to change these terms from time to time as we see fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our SME Launchpad home page or other forms of electronic communication sent to the registration you provided.

Our SME Launchpad and access to our digital displays are provided "As is". We make no guarantees that they will always will be safe, secure, or error-free, or that they will function without disruptions, delays, or imperfections. To the extent permitted by law, we also disclaim all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

These are the only terms and conditions that govern your use of the SME Launchpad. They supersede any prior agreements. No communication between you and Tractor that is not in writing and signed by a director of Tractor, will be binding on Tractor.

If there are any disputes you agree that they will be resolved subject to the laws of the Republic of South Africa and that you and your business submit to the non-exclusive jurisdiction of the Western Cape High Court, South Africa.

If any portion of these Terms is found to be unenforceable, the unenforceable portion will be deemed amended to the minimum extent necessary to make it enforceable, and if it can't be made enforceable, then it will be severed and the remaining portion will remain in full force and effect.

If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by us.

You will not transfer any of your rights or obligations under these Terms to anyone else without our consent. We may transfer any of our rights or obligations under these Terms to anyone else without your consent.

By participating in the SME Launchpad, Tractor Outdoor reserves the right to utilise participant information and share it with third parties.
